Uniserve DR Tech LLP (“Company”, “We” or “Us” and their connotations) operates a website (URL: www.astromudra.com ) (together called as “Platform/Site”) which is engaged in the business of online astrologic services including career coaching, personal, analysing birth charts and astrology signs and further providing future predictions online (hereinafter referred to as “Services”). The Platform allows Users to locate an Astrologer/Expert and ask questions or request advices and/or service directly from such an Expert/Astrologer. The said Astrologers/Experts are neither employees nor agents nor representatives of Astro Mudra, and Astro Mudra assumes no responsibility for any act, omission, advice, representation, etc. of any such Astrologer/Expert.

These terms of use (“Terms”) describes the terms on which the Company grants end users access to the Platform and shall be read with the privacy policy available on https: https://blog.astromudra.com/privacy-policy Anyone below 18 years of age is assumed to be a child (“Child”) and has parental consent to use the Platform. The parents of the Child or users above 18 years of age are hereinafter referred to as “You”. The term “Users” for the purposes of these Terms shall be read as You and/or Child.

These Terms govern all use of www.astromudra.com (“www.astromudra.com”). By using and accessing the Site, you agree to these Terms, the Privacy Policy, other policies, and all applicable laws and regulations. If you do not want to be bound by these Terms, do not use the Site.

www.astromudra.com reserves the right to suspend or terminate your account and your ability to use the Site or portion thereof for failure to comply with these Terms or any Separate Terms related to a service, for infringing copyright, or for any other reason.

1.     CHANGES IN TERMS

www.astromudra.com has the sole right at any time and without prior notice to revise these Terms. www.astromudra.com will post changes on the Site and it is your responsibility to review these Terms and any modifications.

2.     TERMINATION

www.astromudra.com  has the right at any time and without prior notice to terminate some or all of www.astromudra.com services, any feature or portion thereof, or any products or services offered, and to terminate your right to access or use www.astromudra.com services or any feature or portion thereof.

3.     COMPLIANCE WITH LAWS

You agree to comply with all applicable laws and regulations regarding your use of the Platform. You must be at least 18 years old to use www.astromudra.com .  In the event, you are under the age of 18, it shall be deemed that you have parental consent to use and register at the website. However, if you are a parent or guardian and you provide your consent to your child’s use of the Platform, you agree to be bound by these Terms in respect to their use of the Platform. 4.     CONTENT

The text, images, photographs, graphics, videos, logos, illustrations, descriptions, data, astrological charts, astrological reports, and other material on the Platform, as well as the selection, assembly, and arrangement thereof, are referred to collectively as the “Content”.

The said Content shall be shared with you through various and different online and offline modes such as whatsapp messages, zoom video calls, etc. A set of instructions on how the services can be availed by you shall be shared via email, once you have registered from a particular course/service.

The Content may contain errors, omissions, or may be out of date. www.astromudra.com may change, delete, or update Content at any time. The Content is provided for informational purposes only and is not binding on www.astromudra.com  

All content, logos, graphics, pages, scripts, and service names included in or made available through any website are subject to trade dress, trademarks, service marks, and/or copyright law and other laws that protect intellectual property in India and other countries. www.astromudra.com intellectual property may not be used without express written permission of www.astromudra.com. All other trademarks and service marks not owned by www.astromudra.com that appear in any website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by www.astromudra.com.

You may view and use the Content for your personal information and for availing online services for career, personal, birth traits, etc and for no other purpose. www.astromudra.com does not grant to you or any person any right to use, reproduce, copy, download, modify, transmit, display, publish, sell, license, create derivative works, publicly perform, or distribute by any means, method, or process whatsoever, now known or hereafter developed, any of the Content on or transmitted through the Platform.

6.     SERVICE REVIEWS

Service reviews appearing on the Platform are prepared by third-parties (including, but not limited to, review pages, message boards, forums, text files, chats, etc.). www.astromudra.com has not determined whether a specific reviewer’s experience is what an average or typical user may expect to achieve.

7.     ACCOUNTS

Services on the website permit or require you to create an account to participate or to secure additional benefits. You agree to provide, maintain and update true, accurate, current and complete information about yourself as prompted by our registration processes. You shall not impersonate any person or entity or misrepresent your identity or affiliation with any person or entity, including using another person’s username, password or other account information, or another person’s name, likeness, voice, image or photograph. You also agree to promptly notify www.astromudra.com at info@astromudra.com of any unauthorized use of your username, password, other account information, or any other breach of security involving or relating to the Site.

www.astromudra.com  reserves the right to modify, review, delete and refuse to post User Content for any reason.

You, however, warrant and represent that your content, and the content of any website from which You include a link to any site, or to which You post a link from a site will not be inappropriate. Without limitation, content (and the content of third party websites) may be considered inappropriate if:

  10. it impersonates another person or otherwise misrepresents your identity, affiliation or status;
  11. it would be considered a criminal or statutory offense in any jurisdiction, or gives rise to civil liability, or is otherwise unlawful; and/or

www.astromudra.com shall not be held responsible for, and does not endorse the opinions, advice or recommendations in User Content and specifically disclaim all liability in connection therewith.

9.     PUBLIC FORUMS AND COMMUNICATION

“Forum” means an area, site or feature offered as part of a Site that allows users to distribute User Content for viewing by Site users, including a chat area, message board, messaging, social community environment, profile page, blog, and e-mail function.

You acknowledge that Forums and features offered therein are for public and not private communications, and you have no expectation of privacy with regard to any User Content. You further agree that your communications will comply with all rules set forth in section 8 above. www.astromudra.com  cannot guarantee the security of any User Content and you make such disclosures at your own risk. www.astromudra.com has no duty to monitor any Forum.

11. ELECTRONIC COMMUNICATION

By using this Platform you consent to receive communications from www.astromudra.com electronically. www.astromudra.com  will communicate with you by email or by posting notices on the Platform/Website/Application. You agree that all notices, disclosures, agreements and other communications that www.astromudra.com provides electronically satisfies any legal requirement that such communications be in writing. You agree to  receive promotional calls on the number shared, and such calls and SMS would be coming from a third party platform.

Links to other websites operated by third parties, including www.astromudra.com vendors, do not constitute sponsorship, endorsement, or approval by www.astromudra.com of the content, policies, or practices of such linked sites. www.astromudra.com does not operate, control, or maintain linked sites and is not responsible for their availability, content, security, policies, or practices. Links to other sites are provided for your convenience and you access them at your own risk.

 

13. ACCURACY AND AUTHENTICITY OF CONTENT

(i)             We have taken all the required precaution to maintain the accuracy of the Content.

(ii)            Present content could be more relatable to published date and time and may not match the current timing.

(iii)         The results and effectiveness from our services vary from person to person and how they implement it in their situations. Therefore, www.astromudra.com and its affiliates should not be held responsible and liable for any non-performance matters.

(iv)         Any opinion, response, advice, suggestion, prediction, information and/or other service provided by any such Astrologer/Expert is provided for entertainment purposes only and Astro Mudra does not validate the information or advice provided to you by such an Astrologer/Expert.

 

14. PRICING INFORMATION

While www.astromudra.com  strives to provide accurate pricing information for each and every service being availed through the website, however pricing or typographical errors may occur. Unless the services intended to be availed by you has commenced, your purchase will not be deemed accepted and www.astromudra.com  will have the right to modify the price of the service and contact you for further instructions using the e-mail address provided by you during the time of registration, or cancel your purchase and notify you of such cancellation. If we have to cancel your purchase after we have processed the payment, the said amount will be reversed back to your original mode of payment, within a period of thirty (30) days from the date of cancellation . We strive to provide you with best value; however prices are subject to change without notice.

15. REFUND

In case your resort to de-register or cancel your enrolment from a service already paid for, you can ask for a refund expressly in writing via email. However, the refund policy can only be availed within 10 days of your purchase, and not any time thereafter, whatsoever. The refund amount will be credited back into your account (be it debit/credit card) within a period of thirty (30) days from the date of acceptance of your request for refund, in writing.

16. CONFIDENTIALITY

We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by www.astromudra.com will only be in connection with the provision of agreed services and products.

User Account, Password, and Security: 
The user is provided with a password and account designation upon completing the Website’s registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify www.astromudra.com of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. www.astromudra.com cannot and will not be liable for any loss or damage arising from your failure to comply with this Section.

 

17. LIMITED LICENSE

Astro mudra grants its Users a limited, non exclusive, revocable right to use its website provided that the User does not copy, modify, create a derivative work of, reverse engineer or otherwise attempt to discover any source code thereof, and provided further that you remain fully compliant with all terms and conditions of this Agreement and all other policies referenced herein or otherwise made available on the Sites.

 

18. HOLD HARMLESS AND INDEMNITY

To the maximum extent permitted by applicable law, you agree to hold harmless and indemnify www.astromudra.com, its parent company, and their respective subsidiaries, affiliates, officers, agents, licensors, co-branders or other partners, and employees from and against any third-party claim arising from or in any way related to your use of the Platform, including any liability or expense arising from all claims, losses, damages (actual and/or consequential), suits, judgments, litigation costs and attorneys’ fees, of every kind and nature.

 

19. DISPUTE RESOLUTION

These Terms and Conditions and all transactions entered into on or through the Website/Application and the relationship between You and www.astromudra.com shall be governed in accordance with the laws of India without reference to conflict of laws principles.

19.1 All disputes, differences or questions concerning or connected with or in relation hereto the Website, these Terms and Conditions, the Agreement(s) or any transactions entered into on or through the Website or the relationship between You and www.astromudra.com (“Dispute”), shall at the first instance be resolved through good faith consultation, which consultation shall begin promptly after a Party has delivered to the other Party with a written request for such consultation.

 

19.2 If the Parties are unable to resolve the Dispute within 30 Days of commencement of consultation proceedings, the dispute shall be submitted to and settled by way of Arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996. The seat for arbitration shall be New Delhi, India. The language used in the arbitral proceedings shall be English and all awards shall be made in the English language.

 

19.3 The Parties shall mutually agree to choose 01 (one) person to be the sole arbitrator. In case no mutual agreement upon choosing such arbitrator is arrived at within a period of 30 days, the arbitrator shall be appointed per the terms of the Arbitration and Conciliation Act, 1996.

 

19.4 The decision of the arbitrator shall be final and binding on the Parties and judgment may be entered thereon, upon the application of either Party to a court of competent jurisdiction. The award may include an award of costs, including reasonable attorney’s fees and disbursements.

 

19.5 During the period of submission of arbitration and thereafter until the granting of the award, the Parties shall continue to perform all their obligations under this Agreement without prejudice to a final adjustment in accordance with such award, unless a stay over such obligations is granted to either or both parties under such arbitration proceeding or by a court of competent jurisdiction.

 

Any and all service of process and any other notice in any such claim, action or proceeding with respect to this Agreement shall be effective against a party if given as provided herein.

 

20.  GENERAL TERMS

  • Entire Agreement/Severability. These Terms of Use, together with the App Terms, Privacy Policy, and any amendments and any additional agreements you may enter into with www.astromudra.com, shall constitute the entire agreement between you and www.astromudra.com If any provision of these Terms of Use is deemed invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms of Use will remain in full force and effect.
  • No Waiver. No waiver of any term of these Terms of Use shall be deemed a further or continuing waiver of such term or any other term, and www.astromudra.com failure to assert any right or provision under these Terms of Use shall not constitute a waiver of such right or provision.
